Warranty
Effective as of June 1st, 2019
Every Cinch product is supported by a 12-month warranty, as explained below.
Warranty against defects
Cinch offers a 12-month Limited Warranty against defects in material and workmanship, computed from the date of delivery of your items.
Please ensure that you retain your order confirmation as this document will be necessary for you to exercise your warranty rights.
Warranty coverage
The Warranty only applies to products manufactured by or for Cinch that can be identified by the Cinch trademark or logo affixed to them. Cinch warrants each of the Cinch products against defects in materials or workmanship (“defects”) for a 12-month Warranty Period, computed from the date of receipt of the product by the purchaser (“Warranty”).
If a product is replaced during the Warranty Period, the replacement product will be warranted for the remainder of the Warranty Period of the original product.
Exclusions
- Defects that come from normal wear and tear;
- Defects caused by accident, neglect, abuse, misuse, misapplication, or non-Cinch products;
- Defects caused by exposure to extreme natural conditions, liquids, or gases;
- Defects caused by handling by third parties (such as postal service, airlines, hotels, etc.);
- Defects caused by service (including repairs) performed by anyone other than a Cinch authorized representative;
- Defect caused by a modification of a product without Cinch’s permission;
Remedies
Limitation of warranty
THIS WARRANTY AND THE REMEDIES SET FORTH IN THIS DOCUMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER WRITTEN OR ORAL, EXPRESS OR IMPLIED. CINCH SPECIFICALLY DISCLAIMS ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT.
CINCH DOES NOT WARRANT THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR PROVIDE A REPLACEMENT PRODUCT THAT MEETS ALL THE CHARACTERISTICS AND FUNCTIONALITIES OF THE ORIGINAL PRODUCT.
The Warranty gives you specific legal rights and you may have other legal rights depending on the region or state in which you reside. Because some states do not allow the exclusion or limitation of implied warranties, some of the above exclusions or limitations may not apply to you. In such states, Cinch’s warranty is limited to the greatest extent permitted by applicable regional and state law.
This Warranty is only extended to the original purchaser or gift recipient of a product.
Limitation of damages
CINCH IS NOT RESPONSIBLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (SUCH AS LOSS OF CONTENT, LOSS OF USE, LOSS OF TIME, ETC.), OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE, CAUSED BY A PRODUCT DEFECT.
Some regions and states do not allow the exclusion or limitation of incidental or consequential damages or exclusions, thus the above exclusions may not apply to you.
How to obtain warranty service
If you detect a defect in your Cinch product during the 12-month Warranty Period, you should contact our Customer Service Department – info@cinchpopuptents.com, to discuss repair or replacement of your product.
When you contact the Customer Service Department, you will be asked to provide:
- Your name;
- Your address and telephone number;
- Your receipt ;
- The date of purchase; and
- details and images of the defect
A customer service representative will provide you with a solution, including the relevant instructions on how to ship your product to our Service Center if appropriate.
Following receipt of the product, we will check the product and will issue a report indicating whether the product needs to be fixed or replaced and whether its defects are covered by the Warranty.
IMPORTANT: Please provide a copy of your order confirmation to the Service Center to be covered by the Warranty.
IMPORTANT: Before you deliver your product for warranty service, it is your responsibility to empty your products and verify that you have not left any object or item in the products, such as in its pockets. Cinch is not responsible for any items left in products sent to us for repair or replacement.
Product Replacement
If the product needs to be replaced, we will keep the product and will arrange to provide you with a new product. If the product is no longer available, Cinch will substitute the product for a same price product chosen by you. In this case, a customer service representative will contact you to complete the acquisition of this new product.
If the product is irreparable and cannot be exchanged for an identical item, you will be provided with a credit note or a refund.
Delivery
In case of repair or replacement, Cinch will cover any cost of delivering the product back to you. However, you are responsible for the cost of shipping the product to ourselves, including the costs of packaging, shipping, and applicable taxes.
Non-authorized service centers
If you bring your product to a Non-authorized Service Center, any price charged for the repair and any defect caused by their work, will not be covered by the Warranty.
Ownership rights
When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes the property of Cinch. When a refund is given, the returned product becomes the property of Cinch.
Terms of sale
This Warranty Policy is incorporated by reference into the Terms of Sale.
